Welcome to The Terra Class LLC (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your participation in our classes, workshops, livestreams, and your use of our website and online platforms.

By accessing or using any content, services, or offerings provided by The Terra Class LLC, you agree to be bound by these Terms.

1. Nature of Services

The Terra Class LLC provides educational, movement-based experiences, online and in-person workshops, livestreams, and related wellness resources.

All materials and instruction are provided for educational and informational purposes only and are not a substitute for individualized physical therapy, medical care, diagnosis, or treatment.

Participation in any offering does not create a patient–provider, therapist–client, or healthcare relationship.

2. Eligibility

You must be at least 18 years of age to participate in or access any content, services, classes, workshops, livestreams, recordings, or offerings provided by The Terra Class LLC. Minors are not permitted to participate or use the Services.

You agree to provide accurate, current, and complete information when registering for any class, subscription, or event.

3. Baby/Child Presence

Baby/Child Presence: If you choose to have a baby or child present during participation, you acknowledge that the baby/child is not a participant, and you assume full responsibility for the baby/child’s supervision and safety at all times. The Terra Class LLC is not responsible for any injury or harm to a baby/child present during participation. The Terra Class LLC may offer optional suggestions for incorporating a baby/child into certain movements (for example, holding a baby during a functional squat), but doing so is not required and is always the participant’s choice and responsibility. You are solely responsible for deciding whether it is appropriate to hold or incorporate a baby/child during movement and for maintaining a safe environment. If you choose to hold a baby/child during movement, move slowly and stay stable; avoid balance-challenging movements and discontinue immediately if you feel unstable or if the baby/child shows distress.

4. Payments and Subscriptions

Payments for online classes, subscriptions, and in-person workshops are processed securely through trusted third-party platforms such as Fourthwall, Stripe, or PayPal.

Refunds are generally not offered for digital content, except as required by applicable law or as otherwise stated in our Refund & Cancellation Policy.

5. In-Person Events and Workshops

By attending an in-person class, event, or workshop offered by The Terra Class LLC, you acknowledge and agree that:

• Physical participation involves inherent risks, including strain, discomfort, or injury
• You voluntarily assume all risks associated with participation
• You release and hold harmless The Terra Class LLC, its owner, instructors, contractors, and affiliates from liability related to participation
• You are responsible for informing instructors of any relevant limitations, conditions, or concerns prior to class
• Participation does not constitute individualized physical therapy or medical treatment

6. Online Livestreaming and Social Media

The Terra Class LLC may stream educational content through third-party platforms such as Instagram Live, YouTube, or similar services.

By viewing or participating in livestreams:

• You acknowledge that these platforms operate under their own terms of service and privacy policies
• Comments, usernames, and engagement may be publicly visible
• The Terra Class LLC does not control or store data collected by third-party platforms

All livestream content is provided for educational purposes only and does not constitute medical or therapeutic instruction.

7. Intellectual Property

All content, including but not limited to videos, recordings, images, text, graphics, logos, and branding, is the intellectual property of The Terra Class LLC unless otherwise stated.

You may not copy, reproduce, distribute, modify, or share any materials without prior written permission from The Terra Class LLC.

Copyright / DMCA

The Terra Class LLC respects the intellectual property rights of others and expects users to do the same. If you believe that any content available through our Services infringes a copyright you own or control, you may submit a written notice requesting removal of the allegedly infringing material.

Your notice must include:

• A physical or electronic signature of the copyright owner (or authorized representative)
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material you claim is infringing and information reasonably sufficient to locate it (e.g., URL)
• Your name, address, telephone number, and email address
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf

We may remove or disable access to allegedly infringing material and may terminate access for repeat infringers where appropriate.

If you believe your material was removed in error, you may submit a counter-notice including:

• Your physical or electronic signature
• Identification of the removed material and its prior location
• A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
• Your name, address, telephone number, and consent to jurisdiction of the courts in Massachusetts (and acceptance of service from the original complainant)

8. User Conduct

You agree to engage respectfully and responsibly in all online and in-person interactions.

You may not share content that is harmful, discriminatory, inappropriate, unlawful, or violates the rights of others.

The Terra Class LLC reserves the right to remove content, restrict participation, or terminate access at its discretion.

9. No Medical or Professional Relationship

Participation in any class, workshop, livestream, or online content does not establish a clinical, therapeutic, or physical therapy relationship.

If you have health concerns, injuries, pregnancy-related conditions, or other medical considerations, you should consult a licensed healthcare provider before participating.

The Terra Class LLC’s offerings are not a substitute for professional medical or therapeutic care.

10. Limitation of Liability

To the fullest extent permitted by law, The Terra Class LLC and its owners, instructors, contractors, and affiliates shall not be liable for any injury, loss, or damages—whether direct, indirect, incidental, or consequential—arising from participation in any offering or use of our services.

Your sole remedy for dissatisfaction with the services is to discontinue participation.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Terra Class LLC and its representatives from any claims, damages, losses, or expenses arising out of your participation, misuse of services, or violation of these Terms.

12. Modifications and Termination

The Terra Class LLC reserves the right to modify, update, suspend, or discontinue any aspect of its services or these Terms at any time.

Updates will be posted with a revised effective date. Continued use of the services constitutes acceptance of any changes.

12A. Dispute Resolution

Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in Boston, Massachusetts, in accordance with the rules of the American Arbitration Association.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
