The Terra Class LLC Terms of Service

Welcome to The Terra Class LLC (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your participation in our classes, workshops, livestreams,  programs, prerecorded content, digital products, events and your use of our website and online platforms.

By registering for, purchasing, accessing, or participating in content, services, classes, programs, or other activities provided by The Terra Class LLC, and by affirmatively accepting these Terms when requested, you agree to be bound by these Terms.


1. Nature of Services

The Terra Class LLC provides educational, movement-based experiences, online and in-person workshops, livestreams,  prerecorded classes and programs, digital educational content, and related wellness resources.

All materials and instruction are provided for educational and informational purposes only and are not a substitute for individualized physical therapy, medical care, diagnosis, or treatment.

Participation in any class, program, workshop, event, video, or other activity or material offered by The Terra Class LLC does not create a patient–provider, therapist–client, or healthcare relationship.

Even when an instructor is a licensed physical therapist or other healthcare professional, services provided through The Terra Class LLC are not being provided as individualized physical therapy or medical care.


2. Eligibility

You must be at least 18 years of age to participate in or access any content, services, classes, workshops, livestreams, recordings, programs, digital products, or offerings provided by The Terra Class LLC. Minors are not permitted to participate or use the Services.

You agree to provide accurate, current, and complete information when registering for any class, subscription, program, digital product, or event.


3. Baby/Child Presence

Baby/Child Presence: If you choose to have a baby or child present during participation, you acknowledge that the baby/child is not a participant, and you assume full responsibility for the baby/child’s supervision and safety at all times. The Terra Class LLC is not responsible for any injury or harm to a baby/child present during participation. The Terra Class LLC may offer optional suggestions for incorporating a baby/child into certain movements (for example, holding a baby during a functional squat), but doing so is not required and is always the participant’s choice and responsibility. You are solely responsible for deciding whether it is appropriate to hold or incorporate a baby/child during movement and for maintaining a safe environment. If you choose to hold a baby/child during movement, move slowly and stay stable; avoid balance-challenging movements and discontinue immediately if you feel unstable or if the baby/child shows distress.


4. Payments and Subscriptions

Payments for online classes, subscriptions, digital products, prerecorded programs, and in-person workshops are processed securely through Fourthwall and/or other third-party payment processors made available through our website or platforms.

Refunds are generally not offered for digital content, except as required by applicable law or as otherwise stated in our Refund & Cancellation Policy.

For recurring subscriptions, the price, billing frequency, renewal terms, and applicable cancellation instructions will be disclosed before purchase. Unless otherwise stated at checkout, subscriptions automatically renew for the applicable billing period until canceled.

You may cancel an ongoing subscription through your account settings or another cancellation method provided at the time of enrollment. Cancellation stops future recurring charges, and access generally remains available through the end of the then-current paid billing period unless otherwise stated.

5. Participation, Safety, and Participant Waiver

Movement-based participation, whether in person, live online, or through prerecorded programming, involves inherent risks, including physical strain, discomfort, loss of balance, falls, or injury.

You are responsible for determining whether participation is appropriate for you, choosing a safe environment, using equipment appropriately, modifying or discontinuing movement as needed, and seeking healthcare guidance when appropriate.

Participation in movement-based classes, programs, workshops, events, or prerecorded content may also be subject to The Terra Class LLC Participant Waiver and Release Form. Where applicable, you must review and accept that agreement before participation or access.

6. Online Platforms, Livestreaming, and Third-Party Services

The Terra Class LLC may provide classes, programs, digital products, livestreams, video content, payment processing, and other services through third-party platforms such as Fourthwall, Zoom, Instagram Live, YouTube, or similar services.

By using services provided through third-party platforms:

• You acknowledge that these platforms operate under their own terms of service and privacy policies
• Comments, usernames, and engagement may be publicly visible where the platform includes public or social functionality
• The Terra Class LLC does not control how third-party platforms collect, process, store, or use information
• Your access may also depend on the availability and technical operation of the applicable third-party platform

All livestream and prerecorded movement content is provided for educational purposes only and does not constitute medical or therapeutic instruction.

The Terra Class LLC will make reasonable efforts to address access issues within its control but cannot guarantee uninterrupted availability of third-party services.


7. Intellectual Property

All content, including but not limited to videos, recordings, images, text, graphics, logos, class sequences, educational materials, downloadable materials, and branding, is the intellectual property of The Terra Class LLC unless otherwise stated.

When you purchase or otherwise receive authorized access to digital content from The Terra Class LLC, you receive a limited, personal, non-exclusive, non-transferable license to access and use that content for your own personal, non-commercial use. You do not acquire ownership of the content or intellectual property rights in it.

Unless The Terra Class LLC gives prior written permission, you may not:

• Copy, reproduce, republish, distribute, sell, sublicense, or modify our materials
• Share purchased videos, files, playlist links, access links, passwords, or account credentials with another person
• Record, screen-record, download, or otherwise reproduce streaming content except where a download is expressly provided or authorized
• Use The Terra Class LLC materials to teach, train, create derivative commercial content, or provide services to others

Access may be restricted or terminated if we reasonably determine that content or access credentials are being shared, reproduced, distributed, or used in violation of these Terms.


Copyright Concerns

The Terra Class LLC respects the intellectual property rights of others. If you believe content published or controlled by The Terra Class LLC infringes intellectual property rights that you own or are authorized to enforce, please contact theterraclass@gmail.com with enough information for us to identify and review the material.

The Terra Class LLC may remove or modify content when appropriate in response to a valid intellectual property concern.


8. User Conduct

You agree to engage respectfully and responsibly in all online and in-person interactions.

You may not share content that is harmful, discriminatory, inappropriate, unlawful, or violates the rights of others.

You may not interfere with the operation of our website, platforms, classes, or community spaces; impersonate another person; use another person's account without permission; or attempt to obtain unauthorized access to restricted content.

The Terra Class LLC reserves the right to remove content, restrict participation, or terminate access when reasonably necessary to protect participants, enforce these Terms or our Community Guidelines, prevent misuse, or comply with applicable law.


9. No Medical or Professional Relationship

Participation in any class, workshop, livestream, program, event, prerecorded video, digital product, or online content does not establish a clinical, therapeutic, or physical therapy relationship.

If you have health concerns, injuries, pregnancy-related conditions, postpartum concerns, or other medical considerations, you should consult a licensed healthcare provider as appropriate before participating.

The Terra Class LLC’s classes, programs, materials, and other services are not a substitute for professional medical or therapeutic care.


10. Limitation of Liability

To the fullest extent permitted by applicable law, The Terra Class LLC and its owners, instructors, employees, contractors, agents, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to use of our website, digital content, services, or participation in our classes, programs, workshops, or events.

Risks associated with physical participation and applicable releases of liability are addressed more specifically in the Participant Waiver and Release Form.

Nothing in these Terms is intended to exclude or limit liability, remedies, or rights that cannot lawfully be excluded or limited.


11. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless The Terra Class LLC and its owners, instructors, employees, contractors, and agents from third-party claims, losses, liabilities, or reasonable expenses arising from your unlawful misuse of the Services, infringement of another person's rights, or material violation of these Terms.


12. Modifications and Termination

The Terra Class LLC reserves the right to modify, update, suspend, or discontinue any aspect of its services or these Terms when resonably necessary.

Updates to these Terms will be posted with a revised “Last Updated” date. Unless otherwise stated, changes will apply prospectively. Where required by applicable law, we will provide additional notice of material changes affecting an ongoing subscription or other continuing service.

We may suspend or terminate access if you materially violate these Terms, misuse or unlawfully distribute protected content, engage in harmful conduct toward other participants, or use the Services unlawfully.


12A. Informal Dispute Resolution

If a concern or dispute arises relating to these Terms or services provided by The Terra Class LLC, we encourage you to contact us at theterraclass@gmail.com so that the parties may attempt to resolve the matter informally and in good faith before pursuing formal remedies.


13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.


14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


15. Entire Agreement

These Terms, together with any applicable Participant Waiver and Release Form, Refund & Cancellation Policy, Privacy Policy, Community Guidelines, and other policies expressly incorporated or presented in connection with a particular purchase or activity, constitute the agreements governing your use of and participation in the applicable services provided by The Terra Class LLC.
